Federal Judge Mandates Freedom of Abrego Garcia from ICE Custody
A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks lawful basis.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken deportation to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to face alien smuggling charges, he was detained in federal custody.
In her order, the court pointed out that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

The court challenge center on conflicting assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.
He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing criminal case in Tennessee.

The court, who was overseeing his petition to removal in a Maryland district court, ruled that he must now adhere to the terms of his release from custody in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
